经济合同公证程序

(一) 申请。

法人之间、法人与个体工商户、专业户、承包经营户、农户之间依法签订的经济合同，均可向有管辖权的公证机关提出申请，当事人申请公证，应当由法定代表人或委派代表人到公证处。代表人应持有代表权的委托书。当事人申请公证时，必须提交经济合同一式3份，以及其他有关材料。

申请的形式可以采用口头和书面两种。口头申请时，公证机关应制作书面纪录; 书面申请时，应按照一定格式填写申请表。

(二) 审查。

依法审查经济合同应包括以下主要内容：

1. 当事人是否具有合法资格; 当事人是法人的，要审查其是否具有法人资格; 当事人是专业户、个体户时，要审查其是否在工商行政管理机关已

进行注册登记，是否持有营业执照。

2. 合同内容是否符合国家法律、法令、现行政策规定和国家计划的要求。

3. 在签订合同时，是否贯彻了平等互利、协商一致，等价有偿的原则。

4. 合同条款是否齐备，合同的主要条款应包括：标的、数量、质量、价款或酬金、履行期限、地点和方式，违约责任等。

5. 签订合同的手续是否完备。

通过公证人员的审查，认为当事人提供的证明材料不完备或者有疑义时，可以要求当事在接到公证处的通知后，作出必要的补充。公证人员也可以向有关单位、个人进行调查，索取有关证明和材料。如果公证人员认为经济合同不真实，不合法，公证处可予以拒绝办理公证。公证员应当用口头或书面形式向当事人说明拒绝公证的理由和申诉程序。当事人不服公证处的拒绝或认为公证员处理不当，可以向公证处所在地的市、县司法行政机关申诉，由受理申诉的机关作出决定。如果公证人员认为应予公证时，应制作公证文书。

(三) 制作公证文书。

公证人员认为符合法定条件准予公证时，应该按照国家有关规定或批准的格式制作公证文书。公证文书的主要内容包括：申请事项、单位名称(全称) 、公证书编号、办理公证时间、公证员签名和公证机关印章。经济合同公证，一般不写实体证词，只证明双方当事人在合同上签字、印章属实。

公证文书要制成正本两份，一份由公证处存档备案; 另一份交给当事人。根据要求，还可以制成若干份副本。

(四) 交纳公证费用。

当事人办理公证事务，应按照司法部规定的收费办法，交纳费用。
