破产案件首先应由申请人提出申请，申请人分为债权人与债务人。

(8)企业债权情况表，列明企业的债务人名称、住所、债务数额、发生时间和催讨偿还情况;

此外，国有企业向人民法院申请破产时，应当提交其上级主管部门同意破产的文件; 其他企业应当提供其开办人或者股东会议决定企业破产的文件。

2、债权人申请债务人破产，应当向人民法院提交下列材料：

(2)债权性质、数额、有无担保，并附证据;

(3)债务人不能清偿到期债务的证据。
