第三方支付相关法律问题研究
摘要： 第三方支付解决了网络购物过程中资金和货物的安全以及买卖双方的信任问题，解决了制约网络购物发展的瓶颈问题。但是第三方支付同时也存在很多问题，比如第三方支付的性质如何，处于何种法律地位，与其他当事人存在何种法律关系，沉淀资金及其孳息的归属以及保全的问题，对于这些问题法律都没有做出明确的规定。监管不到位制约了第三方支付的发展，所以本文旨在分析这些问题。
